			<content:encoded><![CDATA[<p>Anyhow The <a href="http://techdirt.com/articles/20050105/0132239.shtml">Streisand Effect</a> is getting a bit more coverage these days.  After the Associated Press <a href="http://ap.google.com/article/ALeqM5iDWyWp3GfGD4juECC5_zs64xphOQD8V314PO0">mentioned it</a> the other day, I got to sit down and talk with Robert Siegel for today&#8217;s &#8220;All Things Considered&#8221; where we <a href="http://www.npr.org/templates/story/story.php?storyId=87809195" target="_new">discussed The Streisand Effect</a> starting with the Wikileaks case and moving on to some other cases where the Effect clearly made an appearance.  If this keeps up, maybe we can look forward to a day when lawyers think twice about trying to force perfectly legitimate content offline. </p>

Somthing like that  the Porn Parallel To Viacom Suing YouTube: Vivid Sues PornTube  We all know that <a href="http://www.techdirt.com/articles/20070313/064614.shtml">Viacom is suing YouTube</a>, claiming that the online video hosting site is infringing its copryrights.  However, it looks like a very similar case is happening over in the adult entertainment world, as Vivid, a top adult entertainment video producer, <a href="http://torrentfreak.com/porn-company-vivid-sues-its-own-customer-over-copyright-071211/">is suing PornTube</a>, a YouTube clone that focuses (of course) on pornographic videos.  The argument is basically the same.  PornTube claims that it&#8217;s protected by safe harbors and that it&#8217;s only the service provider and should have no liability.  Vivid claims that PornTube crosses the line and encourages the uploading of unauthorized materials (sound familiar?).  To make this case a little more confusing, there are some additional laws covering the producers of pornographic materials, and Vivid points out that PornTube is not abiding by them, such as the requirement that the producer keep age records of all performers.  To be fair, that particular aspect of the law has recently been <a href="http://www.techdirt.com/articles/20071023/230307.shtml">tossed out</a>, but just in the Sixth Circuit Court of Appeals.  Either way, this lawsuit should basically follow the same path as the Viacom/YouTube one, as the situation and the arguments are likely to be nearly identical. </p>

Okay, okay you may have heard on the news:  chinese Gov&#8217;t Not A Big Fan Of User-Generated Video; Expands Great Firewall To License All Video Sites  It&#8217;s well known that China goes to tremendous lengths to censor and block certain types of content online through a combination of tens of thousands of &#8220;internet police&#8221; combined with vague rules that are left up to various ISPs to enforce or face sanctions (meaning they tend to be even more quick to block than they may need to be).  It appears that even that wasn&#8217;t enough to deal with the rise of user-generated video sites in the country.  The Chinese government has a new policy demanding that all video upload sites <a href="http://www.sfgate.com/cgi-bin/article.cgi?f=/n/a/2008/01/03/international/i022100S78.DTL&#38;feed=rss.business">must get a license from the government</a>, must be state-owned or state-controlled and (of course) must not allow any video that &#8220;involves national secrets, hurts the reputation of China, disrupts social stability or promotes pornography.&#8221;  As the article notes, this likely effects most Chinese YouTube clones (who are mostly private, rather than state-owned), though it&#8217;s unclear how it will impact foreign sites, such as YouTube itself.  The most likely outcome is that ISPs will soon start banning those sites completely in favor of the limited state-owned sites.  Such is life on the internet behind the Great Firewall. </p>
