You Cannot Create A Database Of All Obvious Ideas
regardless of this information As the legal debate over “obviousness” in patents continues, one idea that keeps coming back up is the idea that a bunch of techies should just get together and write down everything obvious they can think of to use as prior art against obvious patents. However, there are a number of problems with this idea, and it could turn out to be more dangerous than helpful. First of all, the number of “obvious” ideas out there is basically infinite — and the problem with most obvious ideas found in patents is simply that they’re so obvious no one even thinks of writing them down for the sake of prior art. Part of the problem is this specific idea that something that’s “obvious” needs “prior art.” Obvious doesn’t necessarily need prior art if it’s either the natural progression of development or something that people simply have always assumed. By trying to set up this “database” of prior art, it is likely to end up being used in favor of obvious patents — as they’ll be able to point to it and say that since so many people are writing down obvious ideas, and this one wasn’t included, then clearly it’s not obvious. It’s great that people are trying to come up with better ways to stop obvious patents from being granted (or abused), but separating prior art from obviousness is important, and such a database does the opposite. That’s why many people are careful only to check for domain registrations on more trusted sites. However, it appears that some scammers may have figured out a way to get the search queries off trusted whois lookup sites. David Berlind points to an article showing how unregistered domain names searched for using CNET’s whois lookup are quickly registered by a company called Chesterton Holdings, who then immediately puts up ads and watches the traffic to see if it’s worth hanging onto. If the site gets no traffic, it is released — just like millions of other such “domain kiting” attempts. What’s unclear is how Chesterton is getting their hands on the search queries. The eWeek piece suggests four possibilities — with three of them being quite unlikely (basically involving someone within one of the companies along the chain giving the info to Chesterton). The fourth suggestion is that somehow Chesterton has compromised the servers to get this info. So, it may upset people to read that Matthew Lasar has alerted us that Clear Channel is working hard to change FCC rules to allow it to take possession of even more radio stations in certain markets. However, the company does have a reasonable point. Unlike just a few years ago, there are many more legitimate competitors to the traditional terrestrial radio market — and the old rules limiting ownership in a market may not make nearly as much sense any more. Where the story gets a bit weird, though, is in the political support Clear Channel has lined up behind its proposal. The quotes from politicians include some bizarre claims about how important it is for the FCC to allow Clear Channel to own 10 radio stations in New York City rather than 8. Apparently, without that change, free terrestrial radio won’t be “capable of fulfilling its public interest responsibilities,” according to Rep. Fred Upton of Illinois. Not only that, but a group of elected officials together filed a combined letter stating that “Given Americans’ reliance on free for both local news and community-oriented programming, as well as essential ‘lifeline’ information during emergencies, natural disasters, we urge the FCC to address this evolving market situation.” Are they really suggesting that if Clear Channel remains stuck with only 8 stations in a city, radio will somehow be less of a “lifeline” of information during emergencies?
